Agreement to Terms

These Terms & Conditions ("Agreement") constitute a legally binding agreement between you ("Client," "you," or "your") and GoodWorks Home Co, a home exterior contractor located in Branson, Missouri ("GoodWorks," "we," "us," "our," or "Company").


By visiting our website, requesting an estimate, or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of this Agreement, please do not use our website or services.


1. Services Provided

GoodWorks Home Co provides exterior home improvement and maintenance services, including but not limited to:

  • Roofing installation, repair, and inspection
  • Siding installation and repair
  • Window installation and replacement
  • Gutter installation, repair, and cleaning
  • Deck building, repair, and maintenance
  • Vacation rental property exterior maintenance
  • Storm damage assessment and insurance claim assistance


Free Estimate

We offer a free, no-obligation free estimate (exterior evaluation) that includes:

  • A comprehensive 60-minute inspection of your home's exterior
  • Photo documentation of findings
  • Verbal explanation of recommendations
  • Design renderings (if applicable)
  • Prioritized action plan


The free estimate does not obligate you to hire GoodWorks Home Co. You are free to obtain competing quotes and make your own decision.


Project Proposal & Pricing

Following your Legacy Assessment, we will provide a detailed written proposal that includes:

  • Itemized scope of work
  • Materials to be used
  • Labor costs
  • Timeline for completion
  • Payment terms and schedule
  • Warranty information


Pricing is valid for 30 days from the proposal date. Changes in material costs or scope may affect final pricing. Any price adjustments will be discussed and approved in writing before work begins.


2. Payment Terms & Conditions

We accept the following payment methods:

  • Cash
  • Check
  • Credit/Debit Card (processed through secure third-party payment processors)
  • Financing options (subject to credit approval)


Payment Schedule

Payment terms will be clearly outlined in your project proposal. Standard payment schedules include:

  • 30% deposit upon signing the contract to secure materials and scheduling
  • 30% upon construction beginning
  • 40% balance upon project completion and your approval


Alternative payment arrangements may be negotiated on a case-by-case basis.


Late Payment

If payment is not received by the agreed-upon due date, we reserve the right to:

  • Pause work on your project until payment is received
  • Charge a late fee of 1.5% per month on the outstanding balance
  • Pursue collection action to recover unpaid amounts


Financing

If you choose to finance your project through a third-party lender, you are responsible for:

  • Meeting the lender's qualification requirements
  • Providing accurate financial information
  • Making all payments directly to the lender
  • Understanding the terms, interest rates, and fees of your financing agreement


GoodWorks Home Co is not responsible for financing disputes or defaults.


Refunds & Cancellations


Before Project Begins:
If you cancel your project before work begins, your deposit will be refunded in full, minus any non-recoverable material or design costs (typically $100–$500, depending on deposits made to suppliers).


After Project Begins:
If you cancel after work has begun, you are responsible for:

  • All labor costs incurred to date
  • Full cost of materials purchased
  • Any additional expenses related to stopping and securing the work site


We will provide an itemized accounting of all costs.


Project Completion:
Once your project is substantially complete and approved, no refunds will be issued.


3. Project Timeline & Scheduling

Start Date & Duration

The proposed start date and project duration are estimates based on typical conditions and are not guarantees. Actual timelines may vary due to:

  • Weather conditions
  • Hidden damage discovered during work
  • Material availability or delays from suppliers
  • Changes requested by the Client
  • Unforeseen site conditions


Weather & Climate

We reserve the right to pause or reschedule work due to severe weather, lightning, excessive heat, or other dangerous conditions. Rescheduled work will be completed at the earliest safe opportunity at no additional cost to you.


Access to Property

You agree to provide GoodWorks Home Co with:

  • Safe, unobstructed access to all work areas
  • Adequate parking for crew vehicles and materials
  • Access to water and electrical outlets if needed
  • Protection for any personal items or landscaping you wish to preserve


If access is restricted or inadequate, we may charge additional fees for delays or equipment rental.


Changes to the Scope of Work

Any changes to the original scope of work must be requested in writing and approved by GoodWorks Home Co. Changes may affect:

  • Project cost
  • Timeline
  • Warranty coverage


A change order will be issued and must be signed before additional work begins.


4. Quality Standards & Workmanship

Craftsmanship Standards

GoodWorks Home Co agrees to perform all work in a professional and workmanlike manner, in compliance with:

  • Current building codes and regulations in Stone County, Taney County, and Barry County, Missouri
  • Industry best practices and standards
  • Manufacturer specifications for all materials used


Site Cleanliness

Our crews will:

  • Clean up job site debris daily
  • Protect your landscaping and property
  • Remove all trash and scraps at project completion
  • Leave the work area in a clean, safe condition


Any damage to landscaping caused by our crews will be repaired or replaced at our expense.


Final Walkthrough

Upon substantial completion, you and a GoodWorks representative will conduct a final walkthrough. We will address any concerns or touch-ups needed. We do not consider the project complete until you have approved it in writing or verbally confirmed satisfaction.


5. Warranty & Guarantees

Money-Back Workmanship Warranty

GoodWorks Home Co provides a money-back workmanship warranty covering:

  • Installation defects
  • Improper sealing or waterproofing
  • Structural failures caused by workmanship (not materials or external forces)


What This Covers:
If any defect in our workmanship is discovered within 10 years, we will, at our option:

  • Repair or replace the defective work at no cost to you
  • Refund the portion of your payment attributable to the defective work


What This Does NOT Cover:

  • Normal wear and tear
  • Damage from severe weather, natural disasters, or Acts of God
  • Damage from improper maintenance by the homeowner
  • Damage from third-party work or interference
  • Material defects (covered by manufacturer warranty)
  • Changes in appearance (fading, color variation) that do not affect function


Manufacturer Warranty

All materials used by GoodWorks Home Co are covered by the respective manufacturer's warranty. We will provide you with all warranty documentation. Manufacturer warranties are separate from our workmanship warranty and may vary by product.


$30,000 Contractor Directory Guarantee

Your project is backed by a third-party Contractor Directory Guarantee of up to $30,000. This guarantee protects your investment by ensuring project completion, even in the event of unforeseen circumstances affecting GoodWorks Home Co. Details and claim procedures will be provided in your project documentation.


Warranty Limitations

  • Warranty covers workmanship only, not materials (unless defective at installation)
  • Warranty is non-transferable (covers only the original homeowner/property)
  • Warranty requires proper maintenance and care of the completed work
  • Warranty is void if work is modified, altered, or repaired by someone other than GoodWorks Home Co
  • Some warranty benefits may require annual maintenance inspections


How to Claim Warranty Service

To report a warranty issue:

  2. Describe the problem with photos if possible
  3. We will schedule an inspection within 14 days
  4. If the issue is covered, we will repair or replace it at no cost


6. Liability & Limitation of Damages

Insurance

GoodWorks Home Co carries:

  • General liability insurance
  • Workers' compensation insurance


You will receive certificates of insurance upon request.


Limitation of Liability

GoodWorks Home Co's total liability under this Agreement is limited to the amount paid by you for the services provided. We will not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of use, loss of enjoyment, or emotional distress
  • Damage to personal property not caused by our negligence
  • Business losses or lost profits


Homeowner's Insurance

You are responsible for maintaining adequate homeowner's insurance on your property. We recommend that you verify that your insurance covers any work performed by GoodWorks Home Co. We will not be responsible for damage not covered by your insurance.


Assumption of Risk

You acknowledge that construction and home improvement work involve inherent risks. By hiring GoodWorks Home Co, you assume the risks associated with such work, except where our negligence is the direct cause of injury or damage.


7. Storm Damage & Insurance Claims

Storm Damage Assessment

We offer free assessments for hail, wind, or storm damage to your exterior. However, assessment does not obligate you to hire GoodWorks Home Co for repairs.


Insurance Claim Assistance

If you choose to hire us for storm damage repairs, we will assist by:

  • Providing detailed damage documentation and photos
  • Preparing repair estimates for insurance submission
  • Communicating with your insurance adjuster on your behalf
  • Explaining coverage details to you


Important: GoodWorks Home Co does not guarantee insurance approval or specific claim payouts. Insurance coverage decisions are made solely by your insurance company.


Payment After Insurance Payout

When insurance approves and pays your claim, we will:

  • Apply the insurance payment toward your project cost
  • Invoice you for any difference between the insurance payout and actual repair costs
  • Proceed with work once payment is received


If insurance denies or reduces your claim, you remain responsible for full payment of the agreed-upon repair cost.


8. Contractor Licenses & Compliance

Licensing & Credentials

GoodWorks Home Co is:

  • Licensed as a home improvement contractor in Missouri
  • Insured as required by law
  • BBB Accredited
  • Member of the Table Rock Lake Chamber of Commerce


License numbers and credentials are available upon request.


Building Permits

For projects requiring building permits (such as new deck construction or major structural work), GoodWorks Home Co will:

  • Obtain necessary permits on your behalf
  • Include permit fees in the project estimate
  • Ensure all work complies with local building codes
  • Coordinate any required inspections


You are responsible for obtaining any HOA approvals before work begins if your property is in a homeowners association.


Compliance with Laws

We agree to comply with all applicable federal, state, and local laws, including:

  • Building codes and safety standards
  • Environmental regulations
  • Labor laws and wage requirements
  • Worker safety requirements


9. Limitation of Availability & Geographic Service Area

Service Area

GoodWorks Home Co serves the following communities around Table Rock Lake:

  • Branson
  • Kimberling City
  • Hollister
  • Reeds Spring
  • Branson West
  • Shell Knob
  • Forsyth
  • Lampe
  • Cape Fair
  • Blue Eye
  • Galena
  • Ridgedale


We do not service areas outside this region. If you request service outside our service area, we will inform you promptly.


Seasonal Availability

Due to weather conditions and scheduling, we may have limited availability during:

  • Winter months (December–February)
  • Heavy storm seasons (Spring and early summer)


We recommend scheduling your project well in advance, especially for summer or fall completion.


10. Communication & Contact

Primary Contact Method

You authorize GoodWorks Home Co to contact you via:

Response Times

We aim to respond to all inquiries within 24 business hours. During peak seasons, responses may take up to 48 hours.


Project Communication

During your project, we will provide:

  • Daily photo updates (via email or text)
  • Weekly progress updates
  • Immediate notification of any issues or delays


Your dedicated project manager is available by phone or text during business hours for questions.


11. Intellectual Property & Use of Images

Before & After Photos

By hiring GoodWorks Home Co, you grant us permission to:

  • Photograph your home before, during, and after the project
  • Use these photos on our website, social media, marketing materials, and Google Business Profile
  • Share photos with our team for training and quality purposes


Opt-Out: If you prefer that we not use your photos for marketing, please notify us in writing. This will not affect your service or pricing.


Testimonials & Reviews

We appreciate positive reviews and testimonials. You may voluntarily:

  • Leave a review on Google, Facebook, or other platforms
  • Allow us to use your name and testimonial in our marketing

We will never pressure you to leave a positive review or claim false endorsements.


Website & Intellectual Property

All content on our website, including text, images, logos, design, and videos, is the property of GoodWorks Home Co or our licensed partners. You agree not to:

  • Copy or reproduce our content without permission
  • Use our name, logo, or images in your own marketing
  • Misrepresent an affiliation with GoodWorks Home Co


12. Dispute Resolution & Arbitration

Informal Resolution

If a dispute arises, we encourage you to contact us first at (417) 386-2786 or tyler@goodworkshome.co to attempt resolution informally.


Mediation

If informal resolution fails, both parties agree to attempt mediation before pursuing legal action. Mediation will be conducted in Taney County, Missouri, with a neutral mediator. Each party will bear its own costs.


Arbitration

If mediation is unsuccessful, any dispute shall be resolved through binding arbitration in Taney County, Missouri, in accordance with the rules of the American Arbitration Association (AAA). Each party will bear its own costs unless the arbitrator determines otherwise.


Limitation on Legal Action

You agree not to pursue legal action against GoodWorks Home Co until you have completed the informal resolution and mediation process.


Small Claims Court

Notwithstanding the arbitration clause above, either party may pursue claims in small claims court if the dispute is within the court's jurisdiction.


13. Indemnification

You agree to indemnify and hold harmless GoodWorks Home Co from any claims, damages, or losses arising from:

  • Your failure to disclose hazardous materials or conditions on your property
  • Your failure to obtain necessary permits or HOA approvals
  • Your failure to provide safe access to the work site
  • Damage to your property caused by third parties (not our crew)
  • Your misuse or modification of completed work


14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.


15. Entire Agreement

This Agreement, together with your signed proposal and any written change orders, constitutes the entire agreement between you and GoodWorks Home Co regarding our services. No verbal agreements, representations, or promises not in writing are binding.


Any modifications to this Agreement must be made in writing and signed by both parties.


16. Governing Law

This Agreement shall be governed by the laws of the State of Missouri, without regard to conflict of laws principles. Any legal action or arbitration shall take place in Taney County, Missouri.


17. Changes to Terms & Conditions

GoodWorks Home Co reserves the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after posting changes constitutes acceptance of the modified terms.
